The article explores the private nature of subjectivity in programs of integration the phenomenology with naturalism. It is considered if their tools are relevant for the phenomenological, rather than naturalistic way of subjectivity’s explaining. Justification of the key ideas is provided with the help of such concepts as “body image”, “body scheme”, (Sh. Gallagher), “ontological significance” (L. Baker), “experience”, “cognitive niches” (F. Varela), “transparent body” (T. Fuchs). Based on the traditional phenomenology of E. Husserl, it is shown that a set (...) of approaches that integrate phenomenology and naturalism within the framework of “first-person philosophy” can be characterized as a phenomenology without a phenomenological subject. It is shown that the phenomenological nature of the self-perspective in integrative programs is more likely to be understood as the qualification and privacy of subjectivity, while the transcendental aspect of the unobservable and biased consciousness is practically not taken into account. The article concludes that the logic of some projects of integration of phenomenology and naturalism overlook this transcendental peculiarity of consciousness, its fundamentally unobserved character. The classical phenomenological approach emphasizes on the extra-natural, biased, and non-empirical nature of consciousness. The role and significance of the phenomenological approach is not limited to the idea of “what-is-likeness” and privacy of subjective states. Phenomenology, which preserves the idea of the subject, means a radical break with the ontology of things and, in general, with the ontology of something objective at all. (shrink)

The publication in 1957 of the Wolfenden Report occasioned a celebrated controversy in which profound theoretical issues concerning the relation between law and morality, and the legal enforcement of morality were discussed. The principal disputants were Lord Justice Devlin and Professor H. L. A. Hart. It is by now well known that the main recommendation of the Wolfenden Report was the reform of the criminal law so that homosexual behaviour in private between consenting male adults should no longer be a (...) criminal offence. As homosexual behaviour in Christendom was at the outset punishable in the ecclesiastical courts, and subsequently, with the demise of the ecclesiastical courts, in the secular courts, the Wolfenden recommendation on homosexuality marked a major departure from the prevailing state of affairs in which the precepts of Christian morality, especially relating to sexual morals, were at first enforced by the ecclesiastical courts, and then by the secular courts. T. A. Cavanaugh defends double-effect reasoning (DER), also known as the principle of double effect. DER plays a role in anti-consequentialist ethics (such as deontology), in hard cases in which one cannot realize a good without also causing a foreseen, but not intended, bad effect (for example, killing non-combatants when bombing a military target). This study is the first book-length account of the history and issues surrounding this controversial approach to hard cases. In spite of the growing interest in nursing ethics, few studies have focused on ethical dilemmas experienced by nurses working with clinical studies as ‘research nurses’. The aim of the present study was to describe and explore ethical dilemmas that Swedish research nurses experience in their day-to-day work. In a qualitative study a purposeful sample of six research nurses from five wards of differing disciplines in four Swedish hospitals was interviewed. The analysis displayed several examples of ethical dilemmas, primarily tensions (...) between the nurses’ obligations to the study and to the patients involved. A guiding moral principle for the nurses was patient-centeredness, where the interest of research must not override the interest of the patient. In situations where tensions between research and patient interests occurred, and doctors and nurses disagreed upon the judgement, the nurses sometimes chose to follow the doctors’ advice, and thus acted against their own moral judgment. Such situations seemed to create feelings of moral distress among the nurses. They described their profession as being ‘invisible’ and as lacking opportunities for ethical competence building. The conclusion is that research nurses frequently experience severe and difficult ethical dilemmas in their daily work. They need to be acknowledged as a particular profession in the health care organisation and encouraged to develop their specific ethical competence. (shrink)

Critical study of Nyāyamañjarī of Jayanta Bhaṭṭa, active 850-910, work on Nyaya philosophy.

Kant's readers have disagreed about whether, according to his account of cognition, concepts, representations of the understanding, are involved in intuitions, representations of sensibility. But proponents of the affirmative 'conceptualist' answer and those of the negative 'non-conceptualist' answer have alike presupposed that such involvement should be construed in a particular way: i.e., as the involvement of particular concepts in particular exercises of sensibility. I argue, on the contrary, that it should not be: that though, for Kant, no concepts are applied (...) in exercises of sensibility, nonetheless the understanding, the faculty of concepts, is teleologically internal to sensibility and, therefore, to its exercises. That is, those exercises are per se directed towards the provision to the understanding of objects to which its fundamental concepts, the categories, are applicable, though no act of categorical application is internal to them. This conception of sensibility, available only in light of a careful distinction between capacities and acts, is demanded, I argue, by Kant's conception of a priori knowledge as elaborated in his Transcendental Deduction. This essay is about the relationship between the notions of practical reason, the will, and choice in Kant’s practical philosophy. Although Kant explicitly identifies practical reason and the will, many interpreters argue that he cannot really mean it on the grounds that unless they are distinct, irrational and, especially, immoral action is impossible. Other readers affirm his identification but distinguish the will from choice on the same basis. We argue that proper attention to Kant’s conception of practical reason as a (...) capacity reveals that these distinctions are neither textually grounded nor philosophically necessary. His moral psychology concerns a single capacity, practical reason, which is the will, and whose actualities in this or that individual fall under the title of choice. Practical reason is the will and choice because it is the rational faculty of desire: a rational being’s capacity to be, by means of her representations, the cause of the actuality of their objects. This, we argue, is entailed by his conception of rational action: action not just in accordance with, but in and through the representation of, principles. The possibility of irrational action is explained not by a distinction between capacities but by the finitude, and thereby the fallibility, of human reason. (shrink)

Professional identity and competent ethical behaviors of nursing students are commonly developed through curricular inclusion of professional nursing values education. Despite the enactment of this approach, nursing students continue to express difficulty in managing ethical conflicts encountered in their practice. This descriptive correlational study explores the relationships between professional nursing values, self-esteem, and ethical decision making among senior baccalaureate nursing students. A convenience sample of 47 senior nursing students from the United States were surveyed for their level of internalized professional (...) nursing values (Revised Professional Nursing Values Scale), level of self-esteem (Rosenberg’s Self-Esteem Scale), and perceived level of confidence in ethical decision making. A significant positive relationship (p < 0.05) was found between nursing students’ professional nursing values and levels of self-esteem. The results of this study can be useful to nursing educators whose efforts are focused on promoting professional identity development and competent ethical behaviors of future nurses. (shrink)

Since 1973 the practice of infanticide for some severely handicapped newborns has been receiving more open discussion and defence in the literature on medical ethics. A recent and important argument for the permissibility of infanticide relies crucially on a particular concept of personhood that excludes the theological. This paper attempts to show that the dispute between the proponents of infanticide and their religious opponents cannot be resolved because one side's perspective on the infant is shaped by a metaphysics that is (...) emphatically rejected by the other. In such a situation philosophical argument is powerless to bring about a resolution because there can be no refutation of one side by the other. (shrink)

The problem of Kant's first Critique is the problem of pure reason: how are synthetic judgments possible a priori? Many of his readers have believed that the problem depends upon a delimitation within the class of a priori truths of a class of irreducibly synthetic truths—a delimitation whose possibility is doubtful—because absent this it is not excluded that all a priori truths are analytic. I argue, on the contrary, that the problem depends on nothing more than the human knower's everyday (...) consciousness of her own finitude: her dependence in thinking and knowing on what is given to her. The problem is a difficulty about how the concepts which figure in metaphysical judgments could represent reality given that they cannot do so in the way in which concepts figuring in empirical judgments do. Empirical judgment here functions as exemplary of thought and knowledge because it is exemplary of finite thought and knowledge. Mere analysis could not, therefore, dissolve the problem even in principle, because to say that a concept can be analyzed is not yet to explain the possibility of its real representative power. The significance of the analytic-synthetic distinction in the context of the problem of pure reason is that its formulation allows Kant to say this. (shrink)

In lieu of an abstract, here is a brief excerpt of the content:372 THE ROLE OF REASON IN HUME'S THEORY OF BELIEF Much has been written on Hume's theory of belief, yet problems of interpretation remain as serious as ever. The most pervasive and persistent problem relates to the role reason plays in Hume's conception of belief. When Hume says that belief is a matter of feeling, does he mean to say that reason has nothing to do with it, or (...) that belief is not a matter of choice? Does he imply that one cannot be blamed for believing as one does? The view that belief is unavoidable and not a matter of choice, and its implication, seem counter-intuitive, if not drastic. Are there grounds for attributing such a view to Hume? There is indeed a tendency to interpret Hume as saying that reason plays no role, not just in the moral sphere, but in the understanding as well. Thus, Barry Stroud claims that "in Hume's hands the denigration of the role of reason and the corresponding elevation of feeling and sentiment is generalized into a total theory of man." Elsewhere I have argued against this view insofar as it relates 2 to Hume's moral theory. But the dismay at Hume's (alleged) denigration of reason is even greater in the case of belief. For instance, Antony Flew considers Hume's view that belief is "a species of natural instincts, which no reason or process of the thought and understanding is able either to produce or to prevent" as a "drastic and disastrous conclusion." According to Flew, one drastic and disastrous consequence of such a view is that "insofar as belief really is necessary and unavoidable we can neither criticize others for the irrationality of their convictions nor retain any 4 confidence about the rationality of our own." 373 In a more sympathetic reading of Hume, J. A. Passmore has cited evidence to show that Hume acknowledges that belief can be a matter of choice, 5 and thus there can be an ethics of belief. However, in doing so Passmore presents an inconsistency in Hume's view of belief, and does nothing to account for this inconsistency. Barbara Winters also sees inconsistencies, or paradoxes, in Hume's treatment, not only within Book I of the Treatise, but also between it and the other two Books (and between the Enquiries). Her resolution of the paradox is the suggestion that there are two conceptions of reason in Hume, the "traditional" and the "naturalistic," the former "plays no role in our acquisition of fundamental beliefs," and the latter is such that we do indeed "arrive at our beliefs through reasoning." In this paper I wish to argue that there are no inconsistencies, or paradoxes, in Hume's treatment of belief, and that his view is neither drastic nor disastrous. I wish to show that there is no 'denigration' of reason, " and that while belief is a matter of feeling, it is also, to an important degree, a matter of choice. In promoting the "undoubted truth, that belief is nothing but a peculiar feeling," Hume does write in such a way as to encourage the interpretation that he subordinates the role of reason to feelings (or sentiments, or passions), or worse, that he denigrates the role of reason. He tells us that belief is not "some new idea, such as that of reality or existence, which we join to the simple conception of an object" (T 623). If it were, "it wou'd be in a man's power to believe what he 374 pleas 'd" (T 624), as the mind can mix or join any two ideas. Hume tells us that we can easily "discover by experiments" that belief "arises immediately, without any new operation of the reason or imagination" (T 102). The widely quoted sentence is the following: "When the mind... passes from the idea or impression of one object to the idea or belief of another, it is not determin'd by reason..." (T 92). This is a condensed description of the contents and overarching argument found in Hippocrates’ Oath and Asclepius’ Snake: The Birth of the Medical Profession. In that work, I maintain that the basic medical ethical problem concerns iatrogenic harm. I focus particularly on what I refer to as ‘role-conflation’. This most egregious form of iatrogenic harm occurs when a physician deliberately adopts the role of wounder. A contemporary practice such as physician-assisted suicide exemplifies a doctor’s deliberate wounding. I argue that the (...) author of the Hippocratic Oath – aware of the chronic risk of role-conflation – responds to this threat by having the oath-taker specifically forswear signal acts that wound the sick, such as giving a deadly drug even if asked, giving an abortifacient, sexual predation, and gossiping. I argue that by means of the Oath, Hippocrates founds medicine as a profession, a practice intimately involving promising. (shrink)
